EU Family Member Residency in Spain: What You Need to Know Before Moving

Published on 22 Nov 2025

EU citizens enjoy freedom of movement across the European Union, giving them the right to live and work in Spain with minimal barriers. However, many new arrivals are surprised to learn that, despite this freedom, EU citizens still must register for residency once they settle in Spain. This registration requires specific documentation, including proof of financial stability and adequate health insurance.

For their non-EU direct family members—such as spouses, children, and dependants—EU law grants the right to join them and obtain Spanish residency as family members of an EU citizen. While this right is solidly protected under EU legislation, it is not automatic. Both the EU sponsor and the non-EU family member must meet certain requirements and follow official procedures within 90 days of arrival in Spain

Key Requirements for the EU Family Member Residency

To successfully obtain residency as a non-EU family member of an EU citizen, applicants must provide documentation proving that they meet the following essential criteria:

1. Valid Proof of Family Relationship
This typically includes up to date marriage certificates, birth certificates, and—in specific cases—documents proving dependency. These documents often need legalisation or apostille and, in many cases, sworn translations into Spanish.

2. Proof of Sufficient Financial Means
Spain requires evidence that the EU citizen can financially support the household without becoming a burden on the Spanish state. Acceptable formats vary, but all must clearly demonstrate stable and sufficient resources to cover the entire period of residency

3. Comprehensive Health Cover
Health insurance—public or private—is mandatory. In case a private policy is required, it is crucial that the chosen insurer is recognised by Spanish immigration authorities. This is why researching the correct policy in advance matters; reputable insurers such as Sanitas are typically well-accepted

4. Proof of Living Together at the Same Address
Registration on the same padron (Town Hall registration) is required to show that the family unit resides together in Spain.

Depending on everyone’s circumstances, additional documentation may be necessary.

Arriving Prepared: Avoiding the Most Common Pitfalls

One of the most frequent challenges families encounter relates to timing and document preparation. Many people arrive in Spain assuming that everything can be organised locally, only to discover that most documents must be obtained from their home country well in advance. These documents may then require apostilles, embassy legalisation, or certified translations—processes that can take weeks.
Starting these steps after arriving in Spain often leads to unnecessary delays, higher costs for express legalisation and international courier services, and increased stress during the already demanding relocation process

Another common issue involves financial documentation, which needs to be presented in a clear and structured format that immigration authorities will accept. Families often underestimate the specificity required, resulting in repeated appointments and rejected submissions.

Health insurance is another area where people frequently struggle. Not all policies meet Spanish immigration criteria, and not all insurers allow every type of applicant. Ensuring that the correct cover is in place before arrival is essential.

Finally, non-EU family members must pay special attention to travel limitations. Those requiring a Schengen visa to enter Spain must secure the visa in advance. Once they arrive, they can apply for residency from within Spain, but travel outside the country before receiving the residency card may not be possible without risking overstaying or encountering re-entry issues
